According to lawyer Stephanie I. Blum, who shared insights with Page Six, Musk likely chose Texas to secure a more favorable child support arrangement compared to what he might obtain in California. Blum explained that Texas law imposes a limit on the child support amount paid by the higher-earning parent.

The legal maneuvering began on September 13th when Musk initially sued 35-year-old Grimes for custody, asserting that he has been the primary caregiver and resident of Texas since the birth of their children. Notably, this preemptive legal move preceded Grimes’ counter-suit by almost a month.

In response, Grimes, a Canadian musician, filed her own lawsuit, accompanied by a standard restraining order preventing either parent from relocating the children from her California residence. She also sought to dismiss Musk’s petition, arguing that the court’s assumption of jurisdiction is inappropriate and would violate principles of fair play and substantial justice.
